Can you drive your car if it fails its MOT?

It depends on two things: whether your current MOT is still valid, and whether the tester listed a ‘dangerous’ problem.

Can you drive it home or to a garage?

After a failed MOT, you can take your vehicle away only if your current MOT is still valid and no ‘dangerous’ problems were listed. Otherwise, you need to get it repaired before you can drive it.

You are responsible for making sure your vehicle is always safe to drive. It can be unsafe even if it has a current MOT certificate.

If your MOT has run out, you can take your vehicle only to have the failed defects fixed, or to a pre-arranged MOT test appointment. In both cases it still needs to meet the minimum standards of roadworthiness at all times, or you can be fined.

What happens if your car fails its MOT?

  1. If your vehicle fails, the result is recorded in the MOT database. You can get a ‘refusal of an MOT test certificate’ from the test centre, and check your MOT history to see the result online. GOV.UK’s sample of this certificate is called “Refusal of an MOT test certificate” (DVSA VT30).
  2. Your vehicle fails its MOT if the test result lists any dangerous or major problems. Whether your vehicle passes or fails, you might also get a list of ‘minor’ or ‘advisory’ problems to monitor or fix in the future.
  3. Get the problems repaired. With a ‘dangerous’ problem, do not drive the vehicle until then.
  4. Get it retested. At the same test centre within 10 working days it can be a free or cheaper partial retest. See the MOT retest rules
  5. Every MOT test is recorded on the MOT database, whether it is a full test or a retest. You can check the new result on our checker. Check MOT history

Failed your MOT before the due date?

GOV.UK gives no separate rule for an MOT that fails before its due date, so the rule for any failed MOT applies. After a failed MOT, you can take your vehicle away only if your current MOT is still valid and no ‘dangerous’ problems were listed. Otherwise, you need to get it repaired before you can drive it.

GOV.UK says you can find out when your MOT runs out by checking your MOT history online, or by checking the date printed on your current MOT certificate, if you have one.

In Northern Ireland the rule is different: see below.

Fines for driving after a failed MOT

You can be fined up to £2,500, be banned from driving and get 3 penalty points for driving a vehicle that has failed its MOT because of a ‘dangerous’ problem.

You can be fined up to £1,000 for driving a vehicle without a valid MOT. You cannot drive or park your vehicle on the road if the MOT has run out, and you can be prosecuted if caught. The only exceptions are driving it to or from somewhere to be repaired, or to a pre-arranged MOT test.

Northern Ireland

nidirect says a vehicle that fails its MOT in Northern Ireland is treated as not roadworthy and should not be on the road, even if there is time left on an existing MOT certificate.

In Northern Ireland, if your vehicle does not pass, the examiner gives you a notification of refusal with details of the faults that have to be repaired for the retest. nidirect says anyone using a vehicle on the road or in a public place without a valid test certificate or with defects may be committing an offence.

Read nidirect: After the MOT/ vehicle test. Our Northern Ireland guide explains what an NI MOT check shows.
